We review SIA (Singapore Institute of Architects) contracts, PSSCOC (Public Sector Standard Conditions of Contract) forms, and bespoke contract documents prepared by developers or main contractors. Our review focuses on payment terms, variation clauses, time extension provisions, liquidated damages, and dispute resolution mechanisms.

How does SOPA adjudication work in Singapore?

Under the Building and Construction Industry Security of Payment Act, a claimant serves a payment claim on the respondent, who has a fixed period to issue a payment response. If the dispute is not resolved, the claimant may apply to have an adjudicator appointed to determine the amount payable. The process is time-bound and relatively fast compared to litigation. We assist at every stage — from preparing the initial payment claim through to enforcing the determination if required.

When should I seek advice on a delay or defect claim?

Ideally before the claim position is formalised. We can assist at any stage — whether you are assessing whether a delay event is contractually compensable, evaluating a defect list served by an employer, or responding to a claim that has already been submitted. Earlier engagement generally allows for a more considered approach to how the claim is framed or contested.

How long does an adjudication proceeding typically take?

Under SOPA, adjudicators are generally required to reach a determination within 14 to 21 days of the adjudication conference, depending on the complexity of the dispute. The process from serving a payment claim to receiving a determination can often be completed within 6 to 10 weeks, though this varies with the specific facts and the adjudicator's schedule.

What information should I prepare before our first discussion?

For a contract review, the executed or draft contract document is the starting point. For a payment or adjudication matter, having the payment claim or response, any relevant correspondence, and the original contract available will help us understand the position quickly. For delay or defect claims, the project programme, defect schedules, and any expert reports or cost estimates already produced are useful context. We will work through whatever documentation is available at the time.
