Payment Claim Dispute — Commercial Office Development

SOPA Adjudication

Challenge

A main contractor had submitted payment claims under a PSSCOC contract that the developer was certifying at a fraction of the claimed amount, citing alleged defects and disputed variations as grounds for withholding payment.

Solution

We reviewed the contract, assessed the payment certification provisions and defects protocol, and prepared a SOPA adjudication application addressing each ground for withholding. Expert input was engaged on the disputed variation values.

Outcome

The adjudicator determined that approximately 80% of the withheld amount was payable. The determination was enforced without further proceedings and the project continued on a revised payment basis.

Delay Claim — Residential High-Rise Project

Delay & Defect Advisory

Challenge

A developer was seeking liquidated damages from the main contractor for a delay of eight months to practical completion. The contractor disputed the LD amount and claimed employer-caused delay events had extended the programme.

Solution

We were engaged by the contractor to assess the delay events against the project programme. A planning expert was brought in to conduct a contemporaneous delay analysis. We then prepared the time extension claim submission with legal analysis of entitlement under the SIA contract.

Outcome

Negotiations resulted in the developer accepting a six-month extension of time, reducing the LD exposure from approximately S$2.4M to S$0.8M. Settlement was reached without formal proceedings.

Pre-Execution Contract Review — Industrial Facility

Contract Review

Challenge

A domestic subcontractor received a bespoke subcontract for a significant industrial facility. The document contained unusual provisions around back-charges, broad set-off rights, and a non-standard defects liability arrangement.

Solution

We reviewed the subcontract and prepared a marked-up advisory identifying eight provisions of concern, with recommended alternative wording for each. The advisory was delivered within five working days of instruction.

Outcome

The client used the marked-up review as the basis for a negotiation with the main contractor. Five of the eight provisions were amended before execution, including the most significant set-off and back-charge clauses.
